The Promotion will be conducted by Neato Robotics Inc., Friedrichstraße 55A, 10117 Berlin (“Promoter”). By entering the Promotion, you confirm that you have read, understood and agreed to these terms and conditions (the “Terms and Conditions”).
I. Eligibility
This Promotion is open to all residents from Germany, aged 18 years or over as of their date of entry, except employees of the Promoter, its agents, their families and anyone professionally connected with this Promotion.
II. How to enter the Promotion
In order to enter the Promotion, participants must complete all of the following three (3) steps before the end of the Promotional Period:

III. Promotional Period
The Promotional Period will run from 00:00 UTC±00:00 on the 22nd November 2021 and will finish on 23:59 UTC±00:00 on the 6th December 2021.
IV. Prize
The Prize consists of one “Neato D10”, which is the newest intelligent robot vacuum of the Promoter. The Promoter will be responsible for shipping the products.
Any other costs incurred in addition to those set out above and that are incidental to the fulfilment of the Prizes are the responsibility of the Winner. A cash payment, change or exchange of the Prize is not possible. Winning claims are not transferable.
V. Drawing of the Winner and obligations of the Winner
The Winner of the Prize will be determined by the Promoter at random via a secure, entirely automated independently verified computer system from all eligible entries within the promotional period.
The Winner will be announced on Monday, 13th December 2021. The announcement is made on the promoter’s country-specific Facebook page . The Winner will be tagged on the Facebook Page. No other announcement will be made.
The Winner must respond within seven (14) business days of being announced by the Promoter. The Winner must then provide to Promoter via Facebook Messenger first name, last name, address and e-mail adress and telephone number in order to receive the prize. The prize will then be shipped within 4 weeks by mail exclusively to the Winner.
If the Winner does not respond within such timeframe, then the Winner's Prize will be forfeited and the Promoter shall be entitled to select another winner in accordance with the process described above.
The same applies in cases where (i) the winner rejects the prize; (ii) the prize entry is made in breach of these terms and conditions; or (iii) the prize cannot be delivered.

VII. General
For participating in the Promotion, no purchase is necessary, however internet connection and a Facebook account are required. No refund may be claimed for expenses incurred in participating in the Promotion, including in relation to use of the internet.
The Promoter reserves the right, in exceptional circumstances, to award an alternative prize of equal or greater value, should the Prize (or any element of it) become unavailable for any reason.
In the event of circumstances outside the reasonable control of the Promoter, or otherwise where fraud, abuse, and/or an error (human or computer) affects or could affect the proper operation of this Promotion or the awarding of the Prize, and only where circumstances make this unavoidable, the Promoter reserves the right to cancel or amend the Promotion or these Terms and Conditions, at any stage, but will always endeavour to minimize the effect to participants in order to avoid undue disappointed expectations. In the event of amendments or changes of these Terms and Conditions, the Promoter will inform the participants accordingly (by editing the Promotion Post or by Facebook Messenger) and the participants can decide whether they want to continue to participate in the Promotion; if not, they can cancel their participation by deleting their comment under the Promotion Post. Claims by the participants for fulfilment and/or compensation in the event of premature termination of the Promotion are excluded.
The Promoter reserves the right, in its absolute discretion, to verify the Winner, including but not limited to, proof of identity and/or age, as required or refuse to award a prize or to withdraw Prize entitlement and/or refuse participation in the Promotion where there are reasonable grounds to believe there has been a breach of these Terms and Conditions or any instructions forming part of this Promotion’s entry requirements or otherwise where a participant has gained an unfair advantage in participating in the Promotion or has won using fraudulent means.
The Promoter, its affiliates, agents, representatives, employees, officers and directors will not be liable for any damages resulting from (i) the application process and entry into the Promotion; (ii) technical failures (e.g., computer, cable, network, hardware or software or other mechanical equipment); (iii) delays or interruptions (e.g., telephone, internet, etc.); (iv) unauthorised human intervention or errors in the entry process or the Promotion (e.g. telephone, internet, etc.); (v) electronic or human error in the administration of the Promotion, the processing of entries and the display of content on any channel. Any liability of the Promoter for the existence of the technical conditions of timely participation in the Promotion or the dispatch of the prizes (permanent access to the websites where participation is possible, or dispatch of the prize by transport companies, or delivery of the prizes by the respective partner) is excluded.
In all aspects of this Promotion, the Promoter’s decision is final and no correspondence will be entered into regarding the Promotion except for the correspondence with the announced Winner regarding the Prize claim according to Sect. V.
VIII. Facebook: Release from liability
By entering the Promotion, you release Facebook from any liability. This Promotion is not affiliated with Facebook and is in no way sponsored, endorsed or organised by Facebook. The recipient of the information provided is not Facebook, but the Promoter. The information provided will be used solely for this Promotion. Any legal claims resulting from the application are to be addressed exclusively to the Promoter, not to Facebook itself. Likewise, any questions or comments regarding the Promotion process or usability should be addressed directly to the Promoter.
IX. Miscellaneous
The recourse to the courts is excluded.
The law of the Federal Republic of Germany shall apply exclusively.
The Promoter reserves the right to make changes to these Terms and Conditions of the Promotion and to suspend the Promotion in whole or temporarily if difficulties arise which may affect the integrity of the Promotion. In this case, participants will be informed of any changes and can decide whether they wish to continue participating in the competition under the new conditions.
Should single terms of these Terms and Conditions be ineffective or become ineffective after conclusion of the contract, the effectiveness of the rest of the Terms and Conditions remains unaffected. The parties are obliged to replace the invalid provision with a valid provision that comes closest to the objective of the contract, taking into account the economic interests of both parties. The same procedure shall be followed if a loophole requiring supplementation becomes apparent during the performance of the contract.
